A comment on Don't Overplay Your Hand: Plaintiffs Frequently Make the Wrong Choice

I have had over 25 civil trials. I have found that the big verdicts come when the insurance company makes a miscalculation in the merits of the plaintiff's case. That means some showboat adjustor or attorney that thinks they are a know it all.

You need a very sympathetic plaintiff. Its helps to have a target defendant. You need to have a dispute that the defendant manufactures on weak evidence. You need a real substantial injury.

The old saying goes "try your winners, settle your loser" that's so true. you just have to recognize which is which.

A comment on Motorcycle Deaths Linked with Rising Gas Prices

I like the idea of personal injury cases involving injured motorcyclists will be much better received. I personally believe that people are finding better ways to go green or conserve energy and driving a smaller vehicle like a motorcycle is one of those ways.

A comment on More Motorcyclists Getting Killed on the Road

That's because they are #1 built just as racing bikes are, but they out headlights on them and call them "crotch rockets" #2 reason is put a guy especially on one at age 17-25 and they have the power to go 0-60 in a few seconds #3 seeing motorcycles is a lot more difficult (especially for the elderly) I lost my 22 year old son on a "crotch rocket" and believe they should be outlawed. They are nothing more than a "murdercycle" waiting for that accident to happen.

A comment on 7 Year Old Boy Dies Off Cruise Ship

Thanks for the comments. A few points:

First, the accident was referenced for illustrative purposes. Second, even if an "excursion" is not directly arranged by the cruise line, liability can still attach if the cruise line recommends vendors which, for example, it knows to have questionable safety records.

A comment on It is Important to Consult an Attorney After Suffering a Traumatic Brain Injury

We had an attoney for my husband's accident and guess what, he was an idiot and I did much of the work. But he got his $. Now we are out of money for my husband's care and I am on the road to poverty.

So people should be very careful of who they chose. This is difficult because they are in a time very high stress.
