Student Hit at Crosswalk Entitled to UIM Coverage

A 15-year old girl was hit Friday morning by a pickup truck while crossing the street at a marked crosswalk. The driver who hit the student fled the scene of the accident; police continue to search for the driver.

The Stadium High School student was transported to the hospital with a broken leg.

The injured pedestrian should be entitled to UIM coverage under her parents' insurance policy. However, it should be noted that the UIM carrier stands in the shoes of the at-fault driver and will take an adversarial position to its insureds. Just because they purchased the policy and paid premiums year after year doesn't mean that the families' insurance carrier won't fight tooth and nail to pay out as little as possible.
