When you're hurt by a government employee, you have to file what’s called a tort claim form before you can file suit. This rule applies to cities, counties, states or the federal government.

This pre-suit process is ostensibly designed to allow governmental entities to “adjust” claims before lawsuits are filed. While this makes sense in theory, the reality is that the tort claim process is used to deny paying claims to injured persons who deserve compensation.

Our legislature and judiciary has created a virtual minefield of obstacles to recovery. That minefield should be navigated with the assistance of a personal injury attorney.
